Subject of the Agreement<\/b> The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale of the second-hand vehicle requested or selected by the Buyer through the OtoVade+ website or other distance communication methods. This Agreement is governed by Turkish Consumer Protection Law, the Regulation on Distance Contracts, and the Turkish Code of Obligations.<\/p>\n<p data-path-to-node=\"66\"><b data-path-to-node=\"66\" data-index-in-node=\"0\">3. Sales Price and Payment Method<\/b> <b data-path-to-node=\"68\" data-index-in-node=\"34\">4.1. Cash Sale:<\/b> Total Sales Price: [Amount]. Payment must be completed before delivery. <b data-path-to-node=\"68\" data-index-in-node=\"122\">4.2. Installment Sale:<\/b> Down Payment: [Amount], Number of Installments: [Number]. Vehicle Inspection Report and Disclosure<\/b> The Seller provides available information. The inspection report is presented to the Buyer before notary transfer. Matters stated in the report cannot be claimed as defects later. Hidden defects are subject to the Turkish Code of Obligations.<\/p>\n<p data-path-to-node=\"70\"><b data-path-to-node=\"70\" data-index-in-node=\"0\">6. Delivery and Notary Transfer<\/b> Ownership transfer is completed before a notary public. The vehicle is delivered after the notary sale and payment fulfillment. From delivery, the Buyer is responsible for fines, insurance, and taxes.<\/p>\n<p data-path-to-node=\"71\"><b data-path-to-node=\"71\" data-index-in-node=\"0\">7. Right of Withdrawal<\/b> Due to the nature of second-hand vehicle sales and official notary transfer, exercising the right of withdrawal after notary transfer may not be possible, except in cases of hidden defects or fraud as permitted by law.<\/p>\n<p data-path-to-node=\"72\"><b data-path-to-node=\"72\" data-index-in-node=\"0\">8. Warranty and Liability for Defects<\/b> The vehicle is sold &#8220;as is&#8221; based on the inspection report. Matters clearly stated in the report or listing cannot be claimed as defects.<\/p>\n<p data-path-to-node=\"73\"><b data-path-to-node=\"73\" data-index-in-node=\"0\">9. Taxes, Fees, and Expenses<\/b> Unless otherwise agreed, traffic fines, motor vehicle tax, and usage costs arising after transfer belong to the Buyer. Notary fees are determined separately between parties.<\/p>\n<p data-path-to-node=\"74\"><b data-path-to-node=\"74\" data-index-in-node=\"0\">10. Buyer\u2019s Representations and Undertakings<\/b> The Buyer represents that they have reviewed the vehicle info, accepted the price, and understand that ownership passes after the notary process.<\/p>\n<p data-path-to-node=\"75\"><b data-path-to-node=\"75\" data-index-in-node=\"0\">11. Seller\u2019s Representations and Undertakings<\/b> The Seller undertakes to provide vehicle documents, conduct the transfer according to law, and process personal data legally.<\/p>\n<p data-path-to-node=\"76\"><b data-path-to-node=\"76\" data-index-in-node=\"0\">12. Protection of Personal Data<\/b> Data is processed for sales, delivery, and legal compliance. Details are in the OtoVade+ Privacy Policy.<\/p>\n<p data-path-to-node=\"77\"><b data-path-to-node=\"77\" data-index-in-node=\"0\">13. Dispute Resolution<\/b> Consumer Arbitration Committees and Consumer Courts have jurisdiction. For commercial transactions, Istanbul Anatolian Courts may be authorized.<\/p>\n<p data-path-to-node=\"78\"><b data-path-to-node=\"78\" data-index-in-node=\"0\">14. Effectiveness<\/b> This Agreement enters into force upon electronic approval or signature.
